Marriott Settles Lawsuit Against COBRA Violation

Attorneys Chad A. Justice of Justice Litigation Attorneys LLC, Luis A. Cabassa and Brandon J. Hill of Wenzel Fenton Cabassa PA represented Spanish-speaking housekeeper, Alina Vazquez in a class action lawsuit against Marriott International Inc. Thousands of former Marriott employees claimed that notices the hotel provided about employees "rights to continued health care coverage under the Consolidated Omnibus Budget Reconciliation Act... were only in English and [were] allegedly incomplete." While the Department of Labor does not require a Spanish-language notice, Marriott was "required to provide Spanish-only speakers... a COBRA notice with an English plan summary that includes a prominent notice... offering assistance to be informed about their rights and obligations."
